A court is a body, often a governmental institution, with the authority to adjudicate legal disputes and dispense civil, criminal, or administrative justice in accordance with rules of law. In common law and civil law states, courts are the central means for dispute resolution, and it is generally understood that all persons have an ability to bring their claims before a court. Similarly, those accused of a crime have the right to present their defense before a court.

Court facilities range from a simple farmhouse for a village court in a rural community to huge buildings housing dozens of courtrooms in large cities.

A court is a kind of deliberative assembly with special powers, called its jurisdiction, or jus dicere, to decide certain kinds of questions or petitions put to it. According to William Blackstone's Commentaries on the Laws of England, a court is constituted by a minimum of three parties, namely, the actor, reus, and judex, though, often, courts consist of additional attorneys, bailiffs, reporters, and perhaps a jury.

The term "court" is often used to refer to the president of the court, also known as the "judge" or the "bench", or the panel of such officials. For example, in the United States, and other common law jurisdictions, the term "court" (in the case of U.S. federal courts) by law is used to describe the judge himself or herself.

In the United States, the legal authority of a court to take action is based on three pillars of power over the parties to the litigation: (1) Personal jurisdiction; (2) Subject matter jurisdiction; and (3) Venue.

How did the Judicial court help end the Salem Witch Trials? And what is the Judicial court?
Q. I don't really understand clearly on how the Judicial court help salem. I know it ended it somehow. I also don't know what the Judicial court is. Do they decide stuff?

A. You are referring, of course, to the 'Supreme Judicial Court' of Massachusetts, which was formed in November 1692, though it was then called the "Superior Court of Judicature". (The name, but not the basic function, was changed by the Massachusetts State Constitution of 1780, which went into effect in 1782.) The timing of the formation of this court and its connection with the Salem Witch Trials is almost an accident of history. James II had suspended the colony's charter in 1684 (for failure to pay duties under the Navigation Acts). After he was deposed in the Glorious Revolution of 1689 an effort was made to obtain a NEW charter. One finally went into effect in May 1692 -- new Governor William Phipps and prominent clergyman… [cont.]

How to motion court to extend time to serve lawsuit on defendant?
Q. I thought my lawsuit had been dissmissed because I could not afford filing fee. I recently received notice from court that I have to appear and answer why it was not served on the Defendant and why all the other documents had not been filed. The forms say I need to file a motion to extend time. I have searched the internet to no avail, but have not been able to find an example or a hit lit of what I need to do.

A. Two things: Either go on line, or go to a bookstore that sells legal self help books. Nolo Press is commonly used. It is a good workbook that walks you through the procedures of the legal system. Also, spend a day at your local law library. They will have practice and pleading guide books. These are operating manuals for attorneys. Think of them like the repair manuals that mechanics use for car repair. The guide books will have examples of the motions you may need. It has also a great section at the end that tells you what to remember to include in the filing. The other person was correct about calling the court clerk to schedule a hearing. That is an absolute and should be done immediately. Then go figure out how to prepare… [cont.]

How do I collect a money judgment granted by the federal bankruptcy court?
Q. I was recently awarded a money judgment by the Federal Bankruptcy court in NJ. On a previous money judgment that I was awarded in county court, I've enforced the judgment by going through the county court system beginning with sending an information subpoena to the debtor and eventually attaching to his bank account. I would like to send an information subpoena to my current debtor but I do now know how to start this process with a judgment from a federal court. Is there a way to still go through the county system to enforce the judgment? The judgment is against an individual not a company.

A. No. You have to enforce the federal judgment with federal execution on the judgment. It will be a process similar to the County Court execution on its judgment, but you have to the the federal system to enforce federal judgments. ** Note: This is a general discussion of the subject matter of your question and not legal advice. Local laws or your particular situation may change the general rules. For a specific answer to your question you should consult legal counsel with whom you can discuss all the facts of your case. **
